Who Needs the License?

An investment company license is required for:

• Portfolio management.
• Performing the administration

of investment funds or foreign investment funds.

We distinguish several categories of investment companies:

• Based on the amount of managed assets:

  • Without authorization to exceed the threshold limit, where the value of the assets in the managed funds may not exceed an amount equivalent to 100 million EUR or 500 million EUR, provided the assets are not acquired using leverage, and the payout of assets to investors cannot occur sooner than 5 years after their collection.
  • With authorization to exceed the threshold limit.

• Based on the types of managed funds:

  • Authorized to manage standard and special funds.
  • Authorized to manage only qualified investor funds (QIFs).

In practice, we most frequently encounter the management and administration of qualified investor funds (QIFs) in the form of SICAV.
